here are my terms of use contract
 

Terms of service

Part 1: Limited Liability contract

My responsibilities:

- educate you about the products being promoted

- answer questions to the best of my availability

- make accurate representations of the companies and merchants presented here

- pay people who refer others to this site using the affiliate program that buy from my advertisers

- promote this site

- maintain, add to, and improve this site.

- offer support to the best of my ability as needed.

- serve as a mediator between you and my advertisers as needed.

Things I don't have control over and are not resposible for:

- pricings of the products and service promoted (that is up to the authors and merchants that I am hosting).  For example, all of the ebooks are priced by the authors themselves, and so.  If you feel a product or program is more expensive than it is worth, I could do my best to see if the merchants are willing to lower their prices, but they have final say on that. 

- process orders, or handle shipping, handling and returns (except when I am selling my own products).  That is up to the merchants themselves.

- web hosting issues.  If the server is down, the site will be down until it comes up again

- glitches with sitebuilder 4.2.  Sometimes, Site builder will be glitchy at times, and when that happens, text I try to post might not appear, objects may appear to be out of place, etc.  Someday, I plan to get a better site building tool (like dreamweaver) when I get the extra money for it, but until then, Site Builder is my main tool.

- your interests.  Since I probably don't really know you personally (given the anonymous nature of the internet), I would not really know who you are, what you are looking for, or what products would benefit you or not.  If you downloaded say the No Nonsense Body Building ebook by Vince Del Monte, for example, but it did not really help you, then I appologieze for that, but obviously, you know your needs better than I do.  This especially applies to people who may have issues needing to be resolved (books on savign a marriage or getting an ex back is especially that way as naturally, every relationship is different, and obviously, some strained relationships will be easier to repair or resurrect than others regardless of resoruce). 

- my advertisers' privacy policies.  If you become at lead at any of my advertisers' companies, you agree to recieve email from them.  Also, some may share your information with 3rd parties while others might not.  See TOS at all advertisers' sites before joining.

- refund policies.  Every merchant and advertiser has their own policies on that regards, and so you will need to check it out before buying.  If you download an ebook, for example, and did not like what it has to offer, it is up to the merchant to give you a refund.  I can't refund you since refunds come out of my commissions anyways.

- money making opportunities (like GDI), I don't have any control over how much you make.  Typically, it takes skill, experience, and decent marketing skills to make money with just about any web marketing opportunity out there.  The better you are with them, the more money you make, while total n00bs may make little or no money at first.

2. Bidding/key words: please do not use "Snohomish Ebook Store" as your primary key words.  It is okay, however to use words like "links to Snohomish Ebook Store", "books from Snohomish Ebook Store", and content like that

3. Privacy: I will see to it personlly that your privacy is guaranteed here.  When I start my own newsletter and start collecting email addresses, I will not give your information to others unless if you request it.  For example, if you want email from my sponsors, I could send your email address to them, but only if you request it.  Otherwise, I will be the only one that sends out newsletters, email messages, etc.

4. Policies concerning ebooks:

- the ebooks are not officially mine, but rather they are given to me to promote, and my job is mainly to promote the authors' works, but it is up to the author(s) themselves to process your orders, answer questions, handle returns/refunds, etc.  Also, the prices for each ebook package have been set by the authors themselves and will vary by ebook and author.  As an affiliate, I do not have any control over their prices, policies, etc.  I would be happy to forward a complaint to them from you about issues that may come up, but the authors themselves have the final say about their ebooks, policies, prices, etc.

- I cannot handle returns or refunds for ebooks you do not like.  You will need to take that up with the author (btw, they take the refunds out of my commissions, and so, I would not have the extra money to refund to you anyways).  Also the authors themselves have their own returns policies, so be sure to check their TOS (or terms of service) agreement for making purchaces

- this website will be a scam/spam free environment, and I will be extra careful to make sure that your experience here is a fine as it can be.  Also, if you have any complaints about any of my sponsors, be sure to email them to complaints@snohomish-ebook-store.net and I will take appropriate measures to make sure it does not happen again, including investigating the claim, contacting the affiliate about your complaint, suspending the affiliate's ads and links on this website, and/or dropping their affiliate program entirely. In extreme cases (such as fraudsters), I will forward the complaint to either my web host, the offender's ISP, and/or local authorities)

- you will need the right software, tools, etc to view the ebooks, including a computer with internet access, adobe reader, macromedia flash (to play videos), and other necessary software to use the ebooks.  If you plan to print out them, you will need to have a printer and a way to store them.  Also, if you happen to delete the ebook, you will need to contact the author about getting a new one.  I can't help you with that, unfortunately.

- Due to the anonymous nature of the internet, I don't really know you personally, and so naturally, it will be impossible to know exactly what your needs are, and so it is up to you to to determine your needs and wants.  Also, there are going to be ebooks that some people may find more useful than others of course.  Of course, I am always open to feedback and suggestions.  If there are ebooks not listed in this website that you want, be sure to email me at webmaster@snohomish-ebook-store.net and I would be glad to post them.  Also, be sure to leave comments about the ebooks for others to see. Include: what the ebook you are reviewing, your name, the area you live in (city, state, country), and your blurbs about the package.

- for me to properly track your transactions in case if you need it (such as complaints), you will need to be sure to visit the sites via my affiliate links.  That is how these companies know who referrs you to them, and if you do so otherwise, you are on your own on that matter.

-  spyware, viruses, etc?  Send me a compliant immediately, and I will take appropriate actions to address the issue (which may include removing that affiliate from my website and referring him/her to law enforcement officials).

- See an ebook you like and want to promote yourself?  You will need to get an account with clickbank and join that author's affiliate program.  It is free to join, and unlike many affiliate networks, you are free to join any affiliate program you want.  Just create a hoplink (or affiliate link) using the hoplink feature, post it on your website or ad enabled blog (note that some blogs do not allow you to post affiliate links, such as myspace, btw) and you will be good to go on promoting it.  Of course, it is up to you to get traffic to your website and conversions (by the way, some of the authors have exclusive tools for people who join their affiliate program via their website to help market their products).  Also, for rebrandable ebooks (or ebooks that are usually free that have affiliate links on them and are often used for promotion purposes), you will need to join that author's affiliate program for the affiliate links to work).

Policies about products from other sponsors (i.e., companies, businessess, etc):

- if you want to promote their products, you will need to apply to join their affiliate programs (many of them have affiliate accounts through www.linkshare.com  and commission junction (www.cj.com), before you can promote their products, services, etc.  Most of those merchants will either accept or decline applicants and some will be easier to join than others.

- orders, shipping & handling, etc.-  for companies that ship their products to you, it is up to them to process your order, ship it out to you and handle returns.  Also, prices of their goods and services will vary by company, and shipping and handling costs will vary as well.  If you order overseas (for example, ordering golfing equipment from England and having it shipped to America), there are 2 things you will need to keep in mind: shipping and handling will likely be more expensive due to the extra traveling expenses, and you will need to make sure that they comply with the customs laws.  If you order a product that is prohibited by customs agents, for example, you will need to check with them before ordering to avoid potiential problems

- lost merchandise: again since my job is mainly to promote, the company you order from is responsible for ensuring that your products arrive in a timely fashion.  If it takes too long or gets lost, you will need to consult that company.

- scammers, fraudsters, etc?  I made sure that all of my affiliates are legitimate businesses and merchants.  However, if you order from a company and feel ripped off, be sure to email me a complaint at complaints@snohomish-ebook-store.net and I will take appropriate actions to address that issue, such as investigating your complaint, contacting the merchant, suspending my service to that merchant, removing dropping that affiliate's program permanently, and/or forwarding your complaint to law enforcement officials.

- other info: be sure to check with the companies' policies about your questions, comments, concerns, etc. 

Policies about affiliate programs, making money via global domains international:

- some opportunities are free to join, while other charge money to take advantage of their services

- Despite the claims by many work at home/internet marketing opportunities that you can make $10k or more per week (or get rich quick), I will be frank with you (and this comes from a newbie perspective): unless if you are great at selling stuff, don't expect to get rich "over night".  Of course, if you are actively promoting what you are given, make your website professional, etc you should start making decent money in commissions over time.  Remember that most affiliate programs pay on a commission and/or per lead basis, and so you get paid for what you sell.  In multilevel marketing programs (global domains international is a mutlievelmarketing firm by the way), commissions come from sales you make and sales that your downline makes.  At global domains, commissions come from each domain your downline members open (domains at GDI usually sell for $10 per month or $120 per yer depending on the plan your referree does), and domains their downline members open going down at least 5 level.  Also, typically high earnings usually do not come right away unless if you are a naturall at selling things. 

- I made sure all of the opportunities I listed are legitimate, but if you feel ripped off by any of them, feel free to email me and I will do what I can to address the issue.

- As an internet marketer (regardless of opportunity), you are essentially your own boss (though your sponsors/upline can act as your advisors, supervisors, etc), and as such, you are pretty much going to be self employed, and so you will need to set your own hours, create your own tasks, hire people (if you do not want to work alone), pay your own taxes, etc.  On downline systems, you will wat to work with people in your up/downlines as a team to help ensure you are successful.

- Also, like just about any career, internet marketing in general is not going to be for everyone.  Here are some requirements you need if you plan to be successful at internet marketing (regardless of opportunity)

  •  it helps to have at least 1 or 2 years of sales-related experience (preferabbly under a commission system)
  • having some web design skills are helpful
  • "You spend money to make money" can apply in just about any internet marketing opportunity.  Typical costs include: web hostng,  advertising, training manuals, traffic exchanges (they are actually free to join, but offer additional services for "upgraded" members), submitting press releases (the only press release service that is truly free that I am aware of is www.free-press-release.com), some article submission directories cost money, advertising on social networks (most of them have anti-advertising policies for people who do not pay to advertise).
  • If you join global domains international or any mlm firm with a downline system, it helps to have some team work/sponsoring skills, since it helps to work to gether on promoting the products, services, etc they have to offer.
  • you must be comfortable with some solicitations, obviously.  After all, you are pretty much a typical sales person, and it is up to you to drive up sales, convrsions, leads, etc.  If you are a Global Domains International member, for eample whenver you get a lead, you will be expected to follow up with that person either by phone or email.
  • it helps to set aside at least 10 hours a week into internet marketing (preferably at least 20 hours a week), especially early on in your internet marketing career.  Typical duties associated with internet marketing includes: actively promoting product/services, accounting, writing press releases/articles, making a blog, web site publishing related stuff (most firms do offer web editors, though), following up with leads, working with upline/downline members (if you are in a mlm), setting aside earnings for taxes, merchandising (if you are a merchant),  email marketing (epecially if you plan to write newsletters), hunting for quality links, revising your website, joining affiliate programs, keeping track of transactions, budgeting, etc
  • If you promote a mlm (such as global domains international), you will have extra work in store when promoting due to the anti-mlm sentiment out there (due to the many scam ones floating around). 
  • you should be business minded
  • If you are new at the internet marketing business, you may want to get someone to work with you on it to help you learn the ropes.  I suggest you find someone to mentor you.  There are professionals that charge a fee to mentor you, but perhaps friends, family, coworkers, etc that have been in the internet marketing business for a while could be quite valuable for learning

Rules for commenting, emails, etc:

- no spamming

- comments should be related to the website and content presented

- no flame wars, please

- no x rated stuff (let's keep this at G-PG13 rated)

- no hacks, viruses, etc

- no illegal schemes (i.e., pyrimads, chain letters, ponzai, and non-legit mlms)

- keep your comments to a reasonable length

- As the web master, I reserve the right to approve or decline comments on an at-will basis

- don't try to get rid of the competition if you are an advertiser, as I want to offer my clients the chance to choose what they want.

Rules concerning the referral link of mine (www.website.ws/ryansjones)

- by entering your name and email address, you aggree to get email from me at least once or twice.  Whenever someone views my GDI referral link, and enters their name, email, etc, I get a message from global domains intl, that someone visited my referral link and that I am supposed to follow up with him or her at least once or twice about the opportunity.  So, don't sign up unless if youare seriously considering the opportunity, because otherwise, I would just be sending you junk mail and that would be a waste of time (in otherwords, no posers please).

- Just about all of the info you need to know about the opportunity is included in the video, tabs, etc.

- You are responsible for you domain registration fees, etc.

- if you enter your phone number, I do have the discretion to call you regarding the opportunity (though I will usually just email you at least once or twice)

- if you plan to make money with global domains international, you will need to actively promote the opportunity and domain names available (you get paid commissions for each domain your downline members register plus additional commissions for each domain their downlines open, provided that they don't quit before the free trial ends)

- Initially you do get a 7

Policies for affiliates:

- Depending on the intrests of my visitors, I really can't guarantee that you will get sales from me.  Of course, if you want better results from me, feel free to help me to drive traffic to my website, help me to boost my conversion rate, etc

- no scams, please!  If you want to advertise an illegal scheme, phishing scams, and other similar activity, then go to someone else for that.  Also, whenver I refer a customer to you, you are responsible for processing the order, handle shipping and handling if you sell goods, handle customer complaints, as well as returns.  BTW, I am encouraging my viewers to report scammers, and if I find out that you are scamming my clients, I will take appropriate measures to make sure that it does not happen again, including warning you about it, suspending my affiliate program with you, dropping the affiliate program, and under extreme circumstances (such as frequent complaints, accounts of fraud, viruses, etc), I may also refer complaints to your ISP and/or law enforcement officials.  Again, no scamming, period.

- I live in the United States,. just FYI, and if you are an over seas affiliate (i.e., England, Spain, China, etc), you will need to consult customs agencies here in America before shipping products to the US.  That will save you legal challenges to get your product to american consumers.

- Don't pressure my clients into buying if they aren't interested.

- I will only refer email addresses fo clients who consent to it

- I will expect commissions for each sale I make (same goes if you are paying on a per click or per lead basis), and if you become deliquent, I will drop your affiliate program

- please do not transmite viruses, spyware, or similar malicious programs for obivious reasons.

- Lastly, no illegail items (i.e., drugs, human traffiking, banned items, etc), for obvious reasons

Final provisions, limitations, etc:

- I do have a day job along side the internet markting business (work in retail environment), and so my hours will vary each day and week

- if you visit my referral link and enter your info, I will try to follow up with you within a day or 2 of your visitation

- If I post my phone number on the website, here are some ground rules on that:

  • please warn me before you do (at least a day or 2 in advance)
  • I do still live with my parents (can't afford to move out yet), and so I will need to run any transactions across them, especially if they require huge investments (say $100 or more)
  • no scams, hate messages, and similar garbage please. 
  • if I am not there when you call, just leave a message and I will try to get back to you ASAP
  • If you are from overseas, I would actually prefer to communicate with you via email, because international calls do get expensive

- server/site down times: there probably will be times when either the site is down or the server is down.  If that happens, I will do what I can to make sure the site is up and running again ASAP.  If the issue is from the website.ws server, then you will need to consult with global domains intl personell about the downtime issues

- I would love it if you provide feedback every now and then.  We do live in an anonymous environment in the online world, but without feedback I would never know how I am doing, what you think about my sponsors, if there are issues I need to be aware of, etc.  Also, if you visit this site and don't see what you are looking for, feel free to suggest it to me.  For retailers, since I have to apply for their affiliate programs, I will need to get a decent ammount of traffice and/or conversions going before I can successfully apply to them all

- be sure to refer this site to a friend if you know someone that might want what is offered here. I can only do so much on my own in getting traffic and customers, I would also be honored if you refer friends, family etc as well.

- affiliate links: you will probably notice affiliate links on my sites (or strange looking links), and they are there because that is how my affiliates know who refers people to their site.  Also, they can also be for your own benefit because then I would be able to keep a record of your transactions and look up transactions as needed.  BTW, if the links take you to a site that is completely different from advertised (for example, you click on a hoplink for one ebook, but get taken to a totally different ebook), then be sure to let me know, and I will make sure that you are redirected to the righ site.  BTW, if you decide to share my referral links with others at networking sites or forums, be sure to consult the TOS of the sites because some of them do not allow you to post referral links, unforutnately.  Want your own affiliate links?  Be sure to join the affiliate programs you want to promote and the merchants you pair up with will give you the links you need.

- I would be more than happy to link to your site if you link to mine.  Just email me at webmaster@snohomish-ebook-store.net and I will post it as long as you link to me as well, is related to what my site offers, and is appropriate.  Note that I do have to be somewhat selective on whose links to post on my site because if link to too many sites, that is usually considered "link spam". 

- I reserve the right to discontinue this site for any reason with or without cause.

new policy- Link theft:

Definition: this is the act of visiting the affiliates of mine without useing my referral links (such as entering someone elses' hoplink url, joining someone else's downline, etc)

Rules:

1. To help keep this site running and to ensure support, I strongly discourage you from using link theft when visiting my sponsors' sites.  If you would be so kind, please visit my affilates' sites through my referral links.  I know that some of you may feel uncomfortable about affilaite links, but those are how companys track who I send to hteir websites.

2. Obviously, I cannot police this policy, but there will be some consequences if you go that route:

a. no support will be given if any issues come up on your transaction.  For example, if you buy an ebook from one of my authors and you can't seem to download it or you feel that you did not get your money's worth, if your transaction shows up on my records, then I could help you.  Otherwise, if it does not show up on my records, then I can't help you.  The best ways to ensure that transactions show up on my records is via the affiliate and referral links I have.  In other words, if you either visit the author's website directly or through someone else's affiliate link, then you are on your own. 

b. If you turn around and promote the links yourself with your own affiliate code, it is up to you to provide support if needed.

c. if you are taking advantage of the revenue sharing program I have to offer (where you can refer a friend to this site and earn a 30% commission off of the sales you bring to this site), link theft transactions will not count.  For example, if the person you refer to my site goes to entirely pets and buys something there through either YOUR affiliate link or directly, that transaction will not be credited to your account.

d. For GDI, if you join someone else's downline, you are on your own.  I can't help you if you do it that way.

e. If you feel like you have been scammed by one of my affiliates and file a complaint, I would not be able to help you since I would not be able to verify the transactions.

f.
